Black out du net français

La quadrature du net lance un "appel HADOPI" appel au black-out du net français

Devant le ridicule d'un gouvernement qui s'entête à vouloir déconnecter du Net des familles entières sans preuves valables ni procès, la Quadrature appelle les citoyens épris de liberté à procéder au « black-out » de leurs sites, blogs, profils, avatars, etc. Comme en Nouvelle-Zélande, seul pays avec la France où la « riposte graduée » devait être imposée par la loi, pour finalement être repoussée : pour protester contre cette loi imbécile et sa « liste blanche » de sites autorisés, le Net français doit agir et se draper de noir.

Pour afficher son soutien, procéder au black-out des sites, informer et afficher une bannière noire du black-out

The french website La quadrature du net call for a black-out of the french web, to resist to the new french law HADOPI
This so called "graduated answer" to what is called "Internet Piracy" i.e p2p networks, downloading, file sharing ... means to filter, control and repress every copyright infringement on the network ! The offenders will see their connection cutted from 3 monthes to one year only upon administrative suspiscion, without trial.
This law meets the interests of the disk and entertainment industries, and is supported by some mediated movies and show-busines stars, and associations linked to the political majority ...
A vast front of civil groups, from associations of artists, journalists, Internet providers, to the European parliament are opposed to this law. The european parliament has declared that disconnecting someone from the internet without having been in trial is against of the European charter of humain rights (freedom of expression and information).
Recently New Zeland has delayed the implementation of the controversial Section 92a «Guilt Upon Accusation law» that calls for internet disconnection based on accusations of copyright infringement without a trial and without any evidence held up to court scrutiny. A huge collective protestation from internet users and web providers had called to a general internet black-out in the country.

Hadopi, une réponse graduée ou totalitaire ?

le nouveau projet de loi du gouvernement Sarkozy propose la mise en place d'une loi dite "création et Internet" qui prétend lutter efficacement contre le piratage, l'infraction au copyright et la création d'une Haute Autorité chargée de mettre en place la répression: filtrage des adresses IP, répression sur les réseaux P2P, blocage des accès internet pour des durées allant de 3 mois à 1 an initialement.
Sans surprise, les lobbies de l'industrie du divertissement et du disque, relayés médiatiquement par quelques stars et quelques associations de parents, associations religieuses, etc , affilées à la majorité politique, soutiennent cette loi à bout de bras.
Ils doivent faire face à un large front critique citoyen:
Cette loi est:

• disproportionnée et iréaliste: difficulté voir impossibilité de filtrer toutes les adresses IP des réseaux
• arbitraire: une adresse IP n'est pas une personne; impossibilité de cibler le seul auteur de l'infraction = punition collective, IP partagée = risque de condamner des personnes étrangères au délit incriminé
• gaspilleuse en recettes publiques: une infrastructure administrative lourde qui risque d'être rapidemment inefficace et dépassée par un objectif irréalisable qui sert principalement à protéger et servir des intérêts privés d'une industrie du loisirs qui refuse de s'adapter aux nouveaux marchés.
• anti-sociale: priver quelqu'un de l'accès à Internet revient à le mettre socialement et professionnellement en quarantaine)
• répressive et totalitaire: l'ensemble de la population est désignée comme suspecte et potentiellement délinquante, elle doit être surveillée et réprimée

Cette loi fait l'objet de plusieurs pétitions en ligne: dont «Téléchargez-moi» des artistes 'contre la loi création et internet'
Le parlement européen*, les associations civiles en france, les associations d'artistes, les fournisseurs d'accès Internet ...
Tous s'opposent à une loi qui représente un acte liberticide de plus dans la lente dérive totalitaire de ce gouvernement.

*Récemment le parlement européen a déclaré, dans un amendement du paquet télécom, que couper la connection Internet d'une personne sans décision judiciaire est contraire à la chartre européenne des droits de l'homme ( liberté d'expression et d'information)

Hadopi: a graduated answer or a totalitarian answer ?

The french government has voted a new law Loi Hadopi, which pretend to protect works, pieces of art .. on the Internet. it is a so called "graduated answer" to what is called "Internet Piracy" understand: p2p networks, downloading, file sharing ...
Not surprisingly, this law meets the interests of the disk and entertainment industries, and is supported by some mediated movies and show-busines stars, and associations linked to the political majority. (right-wings families associations, religious associations ...)
The law will create an adminstration (Hadopi) which mean to filter, control and repress every copyright infringement on the network !
The offenders will see their connection cutted from 3 monthes to one year.

A vast front of civil groups, from associations of artists, journalists, Internet providers, to the European parliament are opposed to this law.
the main critics are:

• It is unrealistic and disproportionate: it is too difficult even impossible to control every IP address on the Internet
• It is arbitrary: an IP address is not a person; more it is shared collectively.The risk to apply collective punishement or to condamn innocent persons is real
• This law is anti-social: to deprive someone of it's internet connection means a social and professionnal isolation
• It is repressive and totalitarian: the entire population is targeted as potentially criminal and need to be controled and even repressed.
• It is a waste of public money: It will create another heavy administrative structure with heavy budget which will be potentially useless because of all the reason above. and whose purpose is mainly to serve and protect private interests of corporate entertainement industries.

Recently the european parliament has declared that disconnecting someone from the internet without having been in trial is against of the European charter of humain rights (freedom of expression and information)

This law is another infringement of people's freedom in this government's slow drift into totalitarism.
